Conditions of Participation for Competitions and Prize Draws
The Stuttgart Convention Bureau, a department of the Stuttgart Marketing GmbH (hereafter referred to as SMG), occasionally stages online competitions and prize draws. Participation in such competitions and draws is governed by the following Conditions of Participation.
The online competitions and prize draws are staged by the Stuttgart Marketing GmbH, Rotebühlplatz 25, 70178 Stuttgart. Any co-organiser involved as a cooperation partner of the SMG will be explicitly named.
Participation Requirements/Prize Draw
Participation in the competition is free of charge and independent of the purchase of any goods or services. Only those participants who have provided all the information required on the respective registration form are eligible to compete. Among all the entries submitted, the winner will be determined in a guaranteed random draw. Only one prize per person will be awarded. No cash alternative is possible, and the prize is non-transferable. The SMG will notify the winners by e-mail. If a winner is unable to confirm his/her acceptance of the prize immediately, he/she forfeits his/her claim to the prize, and a substitute winner will be selected by the aforementioned procedure.
Anyone aged 18 years and over is eligible to enter. Those wishing to participate in the competition/draw must provide true and accurate personal data. Employees of the SMG and its associates, and third parties involved in the competition, including the families of the aforementioned groups, are excluded from entering. The SMG reserves the right to exclude individuals from participating, insofar as justifiable grounds exist, for example violation of the Conditions of Participation, submission of more than one entry, undue influence on the competition, manipulation etc. In such cases, prizes can also be subsequently revoked and reclaimed.
Alterations in the Conditions of Participation and Termination of the Competition
The SMG reserves the right to amend the Conditions of Participation at any time. Furthermore, the SMG reserves the right to terminate or suspend the competition or prize draw for cause at any time without prior notice. This applies in particular to causes which would disrupt or prevent the scheduled implementation of the competition/draw. Should such a termination become necessary due to the behaviour of a participant, the SMG is entitled to claim recompense from the said participant for any damage or loss incurred.
Limitation of Liability
The SMG only accepts liability for damage caused by the SMG, its legal representatives or agents, either wilfully or by gross negligence, or by a breach of essential contractual obligations within the bounds of the competition/draw (so-called cardinal obligations). Essential obligations are those obligations which must necessarily be fulfilled in order to achieve the objective of the competition/draw. In such cases liability is limited to foreseeable damage that might typically occur. Liability on the part of the SMG for damages arising from injury to life, limb or health remains unaffected.
Your personal data and any other information provided will be collected, processed and used exclusively for the implementation and realisation of this competition/draw and subsequently deleted without delay, in accordance with legal requirements. They will not be passed on to any third party.
By entering the competition/draw, the participant agrees to the processing of his/her data. This includes the sending of the prize notification to the contact details provided.
The participant may, at any time, object to the processing of his/her data. However, in this case he/she can no longer participate in the competition/draw. The law of the Federal Republic of Germany shall apply.
Should certain parts of these Conditions of Participation be or become invalid, this does not affect the other Conditions of Participation.
The organisers' decisions with regard to competitions and draws are final, without legal recourse.
The English version of the General Terms and Conditions of Participation is solely for information purposes. The contractual language is German. The German version alone is binding.
